The Legitimate Interest Assessment Pack

The General Data Protection Regulation (GDPR) changes the way you recruit. Processing personal data under GDPR requires a sound legal basis. If you can establish a legal basis for processing your data sets, then you are on your way to demonstrating full compliance with the new laws.

Often, a consent is required. Under GDPR, this means obtaining clear and explicit permissions from data subjects.

In other circumstances, consent is not an option. In these situations, it may be acceptable to process personal data due to a Legitimate Interest. But first, you must be able to identify and document the grounds for that legitimate interest.

Demonstrating A Legitimate Interest

You may be able to process personal data on the grounds of a legitimate interest if no other legal basis exists. However, to do so you must be able to prove your reasoning. With new guidelines outlining the extent of a legitimate interest in the new rules, each process must be assessed on a case-by-case basis.

This pack is designed to make that process as quick and as easy as possible. It can be conducted in-house, and does not require any specific technical or legal knowledge. At the end of the assessment, you will have built a clear case for either continuing, or ceasing, your data processes.

Self-Assessment: Faster GDPR Compliance

The Legitimate Interest Assessment (LIA) pack does not contain specific legal advice. It is a practical resource, and you can use it as one part of your GDPR compliance program. The assessment form is clear and concise, with easy-to-follow guidance notes.

At the end of the assessment, you will have produced a full report which documents your basis for (or against) the processing of personal data.

The self-assessment is versatile, and can be used to assess virtually any process within your recruitment agency. Use it to report on everything from preparing candidate CVs, to conducting marketing campaigns.

Our Legitimate interest report does not only benefit your internal processes. It can also help you to demonstrate compliance to your clients and partners. This will become an increasingly important factor, as organisations work to ensure compliance across their entire data chain. A completed legitimate interest assessment represents a credible resource when proving your compliance to clients.
